Circular No. 02/2023/TT-BXD issued by the Ministry of Construction on March 03, 2023 guides on some contents of construction contracts and takes effect from April 20, 2023. The circular guides in detail some contents of construction contracts; announces and guides the use of the model contract for construction, the model contract for construction consultancy, the model contract for Design – Procurement of materials, equipment – Construction of works (abbreviated as EPC).
This is a very important circular in establishing and managing the implementation of construction contracts under construction investment projects using public investment capital, state capital outside public investment and construction contracts between project enterprises and construction contractors implementing bidding packages under public-private partnership investment projects.
At the same time, organizations and individuals can refer to the regulations in this Circular to establish and manage construction contracts for projects using other sources of capital.
In the model contracts attached to Circular No. 02/2023/TT-BXD, the content and layout have changed significantly compared to previous model contracts. Overall, there has been great progress when absorbing and advancing to the model contracts of the International Federation of Consulting Engineers (FIDIC).
